Throughout England and Wales, the word probate is usually used to describe both the financial and legal process which is involved when dealing with the money, possessions and property of somebody who’s passed away. When you go through probate, this is the process of proving there is a will in place and that will is valid whilst also confirming who has the right authority to distribute assets within the estate. Before anything can be done with the assets of an estate, it has to be confirmed whether a grant of probate is necessary.
